Scenario: Baylor given Death Penalty, SMU takes spot in B12

Postby GreenieSMU » Wed May 18, 2016 3:22 pm

Granted, very unlikely but a SMU | Baylor swap in the Big 12 would seem to hold up well. Both private schools, but give me trips to Dallas over Waco any day. Baylor only got into the Big 12 because Ann Richards was an alum and gov at the time. I would love to see that headline one day! Heck, Baylor death penalty is almost good enough for me!

If they didn't get the DP and B12 ejection after the Dave Bliss incident, I don't think this will do it

Have to agree with this one. If murder and a cover-up don't get you kicked out, then a few unreported rapes won't do it. I suspect there are some other Big XII members who have similar problems.

You do realize don't you that no one will ever get the "death penalty" again...especially any one in a power 5 conference.
SMU's first president, Robert S. Hyer, selected Harvard Crimson and Yale Blue as SMU's colors to symbolize SMU's high academic standards. We are one of the few Universities to have school colors with real meaning...and we just blow them off.

They won't get kicked out of the Big 12 but hopefully they will get hit with sanctions, will be forced to fire Briles, will become a toxic place for a recruit to consider, and finally will take their rightful place back as the doormat of the Big 12, winning one conference game every 5 years.

This is how they were the first 15+ years in the Big 12, time for them to go back there permanently.

Good for SMU and good for the Universe in general. Instant Karma!
Probaly won't happen...BUT...maybe it will!!

Here is what Baylor will get from this: some b.s. penalty that doesn't fit the wrongdoing, then a blue ribbon panel will announce its findings, there will be some degree of protest, then a candlelight vigil, then at the first football game they will all wear some color to increase awareness for rape awareness and sing a song together, then be painted as heroes.

At least that's what Penn St did, more or less

FBI, Justice Department, Title IX enforcement and Civil Courts is where Baylor's conduct should be analyzed and/or investigated. The reason NCAA sanctions against Penn St fell apart is because the alleged conduct by Penn St. as with Baylor in this case is not part of the enforcement scheme or proscribed by the NCAA bylaws in sufficient detail to overcome a due process attack. NCAA would have to rewrite its Bylaws to specifically cover criminal matters which by necessity would always be subordinate to criminal proceedings. If NCAA tried to investigate while a criminal investigation was in progress then witnesses would simply refuse to cooperate in the NCAA administrative proceeding and plead 5th Amendment in criminal proceedings. To do its job NCAA would have to stay investigation until criminal proceedings were concluded (which could take years) because key witnesses wouldn't be willing to testify and government witnesses would be encouraged not to testify based on revealing government strategy. That's a responsible answer to the issue-many prefer emotional outbursts I'm sure. NCAA knows it overreached in the Penn St. matter-the only reason they got away with it for awhile is because it was by Consent decree with Penn St. University.
