Hawaii-ex needs to hire SportsLaw

Postby SMUFan » Wed Jul 09, 2003 11:03 am

Did you read about this?

Former Hawaii guard Anthony Carter has played the last couple of years for the Miami Heat. His contract had a player option for the 2003-04 season - and his agent didn't pay enough attention and FORGOT to turn in the paperwork to the Heat to indicate that Carter wanted to pick up the option for the upcoming season .... which would have paid him just over $4 million this year. So now he's a free agent, and with the NBA's economic landscape being what it is (Gary Payton signing with the Lakers for the mid-level exception?), all indications are that he won't get anywhere near $4 million on the free-agent market. He might have to sign for the veterans' minimum.

SportsLaw - is this a situation where Carter could sue his agent? I guess he could always sue, but would he win? Seems to me the agent should be forced to make up the difference between whatever Carter signs for and $4 million. Is this feasible?

Is that true? That agent not only should be sued, he also should have his license to represent athletes revoked. That's inexcusable, and might have cost Carter money he might never make up.

The agent in this mess is Bill Duffy, who is very respected around the league and represents such players as Carmelo Anthony, Yao Ming and Steve Nash. Quite shocking.

That sucks for Carter - this is why you keep up with your own contract situation (and play a lot better on the court, heh heh).
