SMU Law Prof's Conviction Overturned by Appeals Court

DALLAS - A state appeals court has overturned a Southern Methodist University law professor's conviction of intentionally striking a bicyclist with her car.

Jane Dolkart had been sentenced last summer to five years of probation after a Dallas County jury convicted her of aggravated assault Monday.

But a three-judge Fifth Texas Court of Appeals panel in Dallas reversed the conviction last Wednesday. It ruled that the trial judge gave a Dallas County jury flawed instructions.

Jurors had agreed she used her car as a deadly weapon when she hit Tommy Thomas, who was riding a bicycle at White Rock Lake last May.

I am an avid cyclist and have seen yoyos like this before. It is interesting that she hit another lawyer. Guess being a gender law professor was not too intimidating for her victim.

Also note that she hit two pedestrians crossing Hillcrest prior to trying to take out a cyclist.
