NCAA Takes Interesting Position on Justice Department Probe

Postby Stallion » Wed May 18, 2011 3:04 pm

I love it. They are walking back from the BCS. I think its a great position legally and it lends credence to the argument that a super-majority (read monopoly) has taken control of the NCAA.

I beg to differ from Stallion. The BSC is a cartel that functions as a monopoly.

as long as it is a "contract, combination or conspiracy in restraint of trade" I'll be happy. That's the first element in proving a violation of the Sherman Anti-trust Act. The word cartel is not used as much as monopoly in legal analysis. Cartel is more of a business term I would say. In Anti-trust law they often use the unweildly term of "joint refusal to deal" to describe a cartel.

In criminal law it is more often observed that the victim was killed by the cartel for "refusal to deal joints."
I'd kill for a Nobel Peace Prize.

Your Honor, It wasn't me it was the other guy!

Pathetic and disingenuous !

Yet the NCAA still effects the whole system with its ability to sanction limiting full and fair access.

I hope the whole structure collapses from its internal rot.
