I agree with your sentiment. While I am really hoping he can play, I have been surprised when I see people acting like the only possible reason for him to have his request rejected is that the NCAA hates SMU and is being heartless towards a kid and his family.
While it is great that he can be here in Dallas to be close to his family in a difficult time, that will not change whether he plays football this season or not. It is not like he has to get on a plane and go back to Miami if he cannot play football this year.
I do not know the exact point the NCAA rules on in cases like this. Is it purely whether there exists a legitimate non-football reason for a transfer, and if so he gets a waiver? If that is the case then it seems like a slam dunk.
However, if they are allowed to consider whether there might be any element of a football reason along with a legitimate non-football reason then I think it is a lot less clear. From what I have heard, he was not going to be the primary RB in miami, but he will be here...
