I don't think anyone knows that. This could be true, but the details of the new deal he cut with Bill Byrne for the buyout have not been made public yet. I know they got out of paying most of his buyout because of the NCAA rule violations--and it is speculated that they only had to pay a couple million--but other details are unknown. That very well may have been thrown in there too, it is in a lot of coaches contracts. I can't imagine he is on Turner's list though--42 documented NCAA rule violations? No way they'd go for that.
I don't think so. He gave up a significant portion of his contract due to the email scandal. I believe A&M just cut a check and they went their seperate ways.

Noone can say definitively. The agreement said as much, but nobody knows what the terms of their settlement was. They ultimately paid Fran less than what he was entitled to under that same agreement. If I was Fran, my two goals would have been (i) get as much $$$ as possible; and (ii) ensure I can keep it if I took another job. My suspicion is that Fran won't have to give the $$$ back.
I just do not see how we could accept him (although I would be happy) after the NCAA self reporting violations were submitted by A&M based on his email incident. Granted Indiana took the OU BB coach under worse circumstances, but based on Turner's apparent guidelines I do not anticipate Fran being a part of SMU.
If Fran is who they really want now, I wouldn't think this would stand in their way. While they were violations, they were minor infractions and, from what I read, they really didn't smack of cheating. They did smack of incredible stupidity.
