That is exactly what I was thinking. Give him a 5 year deal with the following payments:

2008 $1,699,999 (from TX A&M) + $1.00 from SMU
2009 $1,699,999 (from TX A&M) + $1.00 from SMU
2010 $999,999 (from TX A&M) + $1.00 from SMU
2011 $1.7million from SMU
2012 $1.7million from SMU
$700,000 bonus form completing the contract with a conference championship.

I don't think he will have any offers outside of SMU, so we need to be careful not to outbid ourselves ala Tom Hicks. Plus year 3 , he needs to take a pay cut so that we can take advantage of the $1 million subsidy. I you want add a 6th year and pay him $1.7 per for years 4-6.

It would almost be worth hiring him just to implement such a contract and screw the aggies.

this settlement has stupid Aggy written all over it. There's no reason why we or some other school can't take advantage of it. It's not unlike the Mavs paying Finley 17 million or so to beat them the other night- EXCEPT A&M doesn't get the monstrous salary cap relief that Cuban got by releasing Finley, so I really don't understand the deal.

Not saying I want Fran, but it makes the possibilities pretty interesting.

there is a duty under basic contractual law that a party suffering damages has a duty to use his best efforts to mitigate his damages

yeah I know that, I'll bet there is some some language in the settlement that specifically addresses it. I suspect you're right though, they can't be that stupid. If he has a duty to mitigate, Fran is most likely contemplating taking a couple of years off.
