This was posted in another thread but I wanted to give it a spot light to maximize responses

In texas, what liabilities are assumed by former employees/employers when talking about each other other?

Depends.

If there was a separation agreement, that document would likely control.

If not, defamation and liable law would be very important.

Most cases probably involve former employers who maliciously attempt to ruin a former employee's reputation with false statements. I can't remember ever seeing a suit by a former employer who was bad mouthed by someone they let go or who quit unless it was tied to a noncompete agreement. For one thing, it wouuld be much harder for the former employer to prove much in the way of damages.

A lawsuit based on a contract that included a confidentiality type clause and liquidated damages would be another animal, but I have never seen a liquidated damages for slander clause in a contract. They may exist, I just havent seen one.

You aren't going to win a libel or defamation suit.

If there was a settlement agreement or contract termination provision, that would control.

Maybe you could get creative and sue June for tortious interference with his own contract hah.

Maybe the COC members can sue June for defrauding them? :lol:

While June's excuses do probably hurt us in the short run, I cannot imagine that any AD with a job opening would look favorably on his complaining. Anyone doing any due diligence at all will discover his many failures.
