Not only was it an infomercial, TCU copywrighted the broadcast. Does the home team always get that right?

Mark Followill, the lead announcer, was SMU's radio voice for years.

Yes. As I understand it generally the conference tv deals cover a certain number of pre-selected home OOC games (believe these are called tier 2 games). Believe this game fell under fox's deal for TCU's tier 3 rights.

TV broadcast is under the contract of the home team. Big 12 contract didn't pick this up in the top 2 tiers and so it fell to 3rd tier rights (TCU's owned rights)
