The ACC this week claimed FSU and Clemson missed their opportunity to push back against the league’s contracts after approving them and accepting millions of dollars from them over years in a legal response to the school’s respective lawsuits.

In its first clearly laid out defense of FSU’s and Clemson’s lawsuits against the conference, the ACC asserted that both schools missed their statute of limitations of three or four years, depending on the state.

So through performance of the contract and reaping the benefits of same Florida State is bound by the contract. That only makes sense. I don't know if I have shared this before but I watched the FSU board meeting when they approved this litigation. Two things irritated me: One, they tried to blame SMU for all of their troubles at one point. Two, the members of that board are some of the most IQ deficient human beings I have ever witnessed holding posts of responsibility to the public I have ever seen and that is quite an achievment. The lawyers were clearly convinced that they would create havoc by filing the suit in front of a friendly forum (a locally elected judge in Tallahassee who happens to be an FSU Alum).

What amazed me is that it was filed by a very well known law firm. I wouldn't have put my name on such a pleading. They also didn't expect a counter-suit in North Carolina. What's even more funny is that apparently by filing such a suit, they spooked the SEC and B1G who have no interest in a "disloyal" partner. I still think there is a deal to be had using our money and Calford's money. It won't be SEC money, but it will be more.

I'm biased b/c I would love nothing more than for FSU/Clemson and the ACC to make up and for all of this to go away, even though I realize the odds of that are slim. But even when I try to put myself in FSU's shoes, their actions are kind of baffling. Its been like one long multi-year tantrum that is damaging their own brand, as well as damaging their current conference. . . .where they will have to remain until this GOR issue is settled. And even then, it will likely cost them hundreds of millions of dollars to settle with the ACC, and they'll then enter into a negotiation with the SEC or BIG where they will have zero leverage and will likely have to take a reduced share to join. Is there really an immediate solution they can see where they do significantly better than they are right now? Because I don't see it.

The North Carolina suit is not a "countersuit." It is actually the primary suit and was filed first. F$U had to post certain decision-making meetings publicly, so the ACC knew what day they would file, and beat them in by a day. It's Florida that is the "countersuit."

Agree with all of this. And don't forget this started because F$U was snubbed by the playoff committee, and I guarantee at least some of the $EC and "Big" XII members of that committee had in mind setting in motion this exact chain of events. The NC State AD should be ashamed of himself for not threatening hellfire and damnation to try to get them in; he just meekly went along.
