NBA Early Entry

Today is the last day for underclassmen to declare for early entry to the NBA draft, and since we havent heard anything about Markus Kennedy, it would seem he isnt leaving. This is a bit of a surprise to me, I thought he would at least test the waters, go to the pre-draft camps and get evaluated, etc., and then maybe withdraw his name in June. I really thought we had seen the last of Markus, but this makes it look more likely that he is staying.
There is one question, does Markus need to declare himself an "early entry"? He has one year of eligibility left, but he has been in college for 4 years, and he turns 24 in August. He did a year at a prep school, so he has actually been out of high school for 5 years. Does his age make him eligible for the draft without declaring for it? Does anyone know the actual rules?
