Who knows if he actually meant to lie Don't have the transcript. Maybe he
misunderstood, or just misspoke Like Turner said, the effects of what he said were short
lived

unfortunately he admitted to the NCAA that he "lied". Used that exact words. But yeah generally you can correct the record later in the same proceeding but the decision maker is entitled to consider both the prior and latter statements and draw their own conclusions therefrom. Especially if a prior lie was exposed by other testimony-which is I believe what the NCAA concluded

as some one pointed out-it looks like SMU couldn't get its story straight among the witnesses-which in and of itself raises questions

Stallion, which that somehow constitutes an atmosphere of non-compliance by Brown? Seeing that Brown probably KNEW that Frazier did not need the class in question to be eligible, it is not unreasonable to see how he could be conflicted about the situation and what to say about it. Was it non-compliance? Well maybe, but not really in a sense because the class did not MAKE him eligible. So the program might have had an unethical lapse (as opposed to Bliss and Paternos illegal lapses but nevermind), but was that a fact or pattern of non-compliance? Keith was either eligible without the class or he wasn't.

second thing, did the NCAA really cite our record 30 years ago from the DP as a factor in the case/punishment? Not only is that ludicrous in every way, it sounds like double jeopardy to me. We obviously paid the full price in the DP and received zero leniency, so how can it be a factor again now????????

NCAA is required to list aggravating and mitigating factors just as a federal criminal court is required to analyze aggravating and mitigating factors in sentencing. They are one of many factors listed for each party in the proceeding just as they would for any university

Its just a consideration of due process in sentencing-an appellate court is required to weigh the factors upon which sanctions are based according statute or in this case NCAA Bylaws-I doubt it played too much of a factor-

Larry said he did not lie. In the quote was Coach Brown simply using someone else's term for it? i.e, they called it a lie and he simply was using the term to be clear in his response? Was the word first used by someone else? If so, this changes a lot about that point in the story.
