Ken Lay Conviction ExpungedApparently, Ken Lay's conviction was expunged today because he didn't live long enough.
If your client is convicted of embezelment and fraud and the govt. is seeking to recoup it, do you have an ethical obligation to tell your client that if he or she died while on appeal, the government couldn't touch the money? I mean, stricktly for estate planning purposes only.
I believe the ABA model rules would require you to present all options and their consequences to the client so that they are fully informed, along with your recommendation for the best course of action. It the client's choice ultimately as to what course to pursue.
If you counciled someone to commit suicide would that count as a violation of the state's ban on assisted suicide? The donkey's name is Kiki.
