As the UVA scandal and Duke Lacrosse illustrate, all Universities are fundamentally incapable of resolving serious felony investigations. Everyone knows it. While they can certainly deal with the kid who has a 12 pack in his dorm room, they are not capable of dealing with what is probable the most difficult crime to fairly adjudicate.
The complaint about a male on male crime resulted in the Dallas County DA's office (which, regardless of which party held the office, has never been accused of being soft on crime) dropping the charges for lack of evidence. In the face of that decision, SMU is going to reach a different conclusion?
BTW - I am not opining on whether the man was or was not assaulted. I just don't think that anyone should seriously expect SMU to do a better job than the felony prosecutor's at the Dallas DA's office.

How does male on male crime violate Title IX? I thought that involved discrimination on the basis of gender. I could see date rapes, like at UVA of women. But male on male? Just seems like a stretch to the statute.

Sexual assault is sexual assault - doesn't matter who does it or to whom it is done.
