Being bad at your job is not "just cause". Pulling a Bobby Petrino act, which included lying to his boss after the immoral activity is an example of just cause.

I understand what your saying. But performing poorly is one thing, flat out refusing to perform one of the most important aspects of your job is another. I know there is nothing that can be done or will be done at this point but I don't know how JJ can sleep at night.
Yes I know this is nothing new but still.

Not saying he should not be gone. Just saying there is no legal grounds for just cause in order to get out of the contract. If that held up there would never be any use for contracts. I do not know many coaches who we'd fired for doing well.

Maybe this is a trivial question, but aren't there two sides to a contract? One side of the contract: We pay you X dollars given that... Second side of the contract: You do your job.

Again I am not on the inside, and I am not a lawyer so I definitely do not understand guaranteed contracts or what is all involved in the politics, retention of a coach, and performance of a coach, but I just can't stomach this blatant disregard for recruiting. This is a slap in the face to SMU and all of us who care about our school and the direction of our football program. How can we sincerely support the direction of our football program?

Who is it that has the authority to actually fire June Jones? Hart? Turner? The COC? Yes money is involved (always is), but I mean really? Does anyone in power care? What are they waiting to happen? What is the next line that June will cross? What if June does not show up for Spring Practice... Will he still have a job? Maybe he decides that he does not have to show up on game day. Will he still have a job then? Really?

No other football program would put up with this behavior from their head coach. Fire his [deleted]!

I'm not an attorney but I'd think it would be something to look at.

Most coaches' contracts outline their duties related to coaching games, practices, and recruiting. I would think that an argument could be made that his lack of effort and current vacation a week and a half before signing day are evidence that June Jones is not upholding his contractual duties... in other words, he has obligations under the contract that he's not fulfilling.

Here, for example, are three clauses from Hugh Freeze's contract at Ole Miss defining "cause" that relate to job duties:

(x) failure by Employee to use best efforts in development of the University's athletics program under Employee's supervision and in support of related organizations;

(xi) refusing or failing to perform any duties reasonably related to Employee's position, or failing to perform the same to the best of Employee's ability, after notice to Employee of the University's expectations;

(xii) prolonged absence from the University without consent of the Director of Intercollegiate Athletics;

I would assume that Jones' contract has similar provisions included... or, I would hope that Jones' contract has similar provisions included.

And all Jones has to do is say he believes his way is best. He will say to look at his record at Hawaii. He will say the problem is SMU, not him. Then we get bad publicity and are not able to hire a decent replacement. It is silly to think there is a just cause reason for canceling the contract based on what I see from where I sit regardless of how poor he is performing.

Can I ask a no BS question?

Since our illustrious coach isn't recruiting anyway... Could Hart have pulled the extension offer to JJ in mid-December? Hear me out. I know about not wanting to go into the final year of a contract with a coach, but the mandatory talking point for him could be that we are ironing out the details. Give it to him in writing. If he violates that, he is in breach of contract or guilty of insubordination, both of which he can be fired for cause. I know this would have left us the problem of paying off the assistants, but won't we have that problem after next season anyway? If the buyout for the extension is really $300k as speculated on PFs wouldn't this solution have saved us the $300k?

This SMU commit appears to be wavering in June's absence

I would fire him right now, and let coach Phillips take the role for 2014.

You might think we are overreacting, but it is time we got serious like other schools, and

not put up with this kind of crap.
