But that's my point-he hasn't missed 2 years due to injury. I ackowledged he could get that 6th year if he had a second injury in his 5th year of eligibility

I did some googling and found this NCAA manual. It is 2009-2010 and so it might not be current and you might know a better source. The hardship waiver (official term for medical redshirt) is 14.2.4. Paragraph (a) says it has to happen during one of the four seasons of competition, but is silent about before/after a regular redshirt year. My interpretation is that he would be able to transfer and play 2 years, if he gets the hardship waiver, but I could be missing a subtlety.
14.2.4 Hardship Waiver. A student-athlete may be granted an additional year of competition by the conference or the Committee on Student-Athlete Reinstatement for reasons of “hardship.” Hardship is defined as an incapacity resulting from an injury or illness that has occurred under all of the following conditions:
(a) The incapacitating injury or illness occurs in one of the four seasons of intercollegiate competition at any twoyear or four-year collegiate institutions or occurs after the first day of classes in the student-athlete’s senior year in high school

Isn't SMU's offense more complicated than UT's

It sucks he lost that year by playing in NC but there are no exceptions. I don't think you can take a redshirt year after a medical redshirt. Now you can get a 6th year if you get hurt in the final year of eligibility even after a redshirt or medical redshirt.
Since he has his regular reshirt left I would think he could take that on the year he sits out. Are you sure you can't take a redshirt year after a medical redshirt?

Would be nice to have Padron start next year, Gilbert the year after and then have Conner as a Junior or the 2013 commit as a RS freshman start in 2014

Assuming that Padron stays at SMU and does not transfer.

Unfortunatly, the question is "Can Kyle get his confidenceback?". I don't see him making that throw in overtime Saturday. I certainly hope I am wrong

He missed a wide open shorter TD pass against UTEP though he may have been under pressure.
Gotta get that head back on straight.

Is Patterson upset that Kyle is dating a TCU girl?

that is true but note that Shipley missed two ENTIRE seasons from start to finish due to injury-not just parts of those seasons. Shipley therefore had a redshirt year and in his final year could apply for the hardship waiver back to his 2nd year which isn't granted until just before 6th season of eligibility. Gilbert hasn't missed even one entire season of injury yet and he hasn't redshirted yet . He played this year the year of injury. Important because by playing he can not be a traditional redshirt. Technically he could possibly not be medically cleared even in 2012. I still think he will not have more than 1 year of eligibility. Note the difference in the Shipley case.

To borrow from Stallion's post:
2009-Lost Redshirt by playing in Rose Bowl (1st Year)
2010: played entire season (2nd year)
2011- played in 2 games (3rd year)
2012-Transfer Year-sit out (Redshirt year)
2013-Plays the year (4th year)
and applies for:
2014 - Medical redshirt year to make up for 2011 Season.
I thought that's how it worked. The "Medical resdshirt" wasn't even addressed until you were out of eligibility and needed an extra year. In this case, Gilbert's normal eligibility doesn't run out until after the 2013 season, so after sitting in 2012, he would still have one season to play, plus the 5th year to make up for 2011.
That's my understanding, he would have 2 years left if he were to get the 5th year.

regular eligibility runs out in 2012.
