Lawsuit waiting to happen-Endzone hill
Most tickets have a disclaimer on the back. That's why the rangers aren't liable if a fan is hit by a bat or ball.

I'm not an ambulance chasing tort lawyer but there is the "attractive nuisance doctrine" that requires owners of property conditions that may attract children to have to exercise a higher level of care to protect them from harm. I'm amazed there aren't more kids hurt over there but they love it. Another problem is the mixing of older more careless kids with the Little Ponies

I am not a lawyer but have taken a couple of undergrad law classes. It seems to me even with disclaimers, SMU still could potentially be liable for a child being injured. It is definitely foreseeable that a kid could get hurt on the hill. Anyways I find the story funny! It drives me crazy every time I look over I see kids rolling down that hill. I think to myself, should this crap really being going on in a Division 1 FBS college football game. Regardless of our lack of attendance issues. Filling in that sections with bleachers may not be such a bad idea. Was that priority 2 or 3 on the Ellerbe Beckert plans?

Is the attractive nuisance doctrine a part of trespassing torts? Therefore if the child has a ticket then he/she has a license to be on the property including the hill. Anyways it does seem to me if the hill was blocked off the attractive nuisance doctrine would come into play. Another idea is to put the child who trespasses on the hill would be placed in a pin with
the rowdy and violent peruna IX for 5 minutes. I feel like this idea would only lead to more legal issues. Haha

i see those dumb kids rolling down the hill every week. it makes me sad that those parents don't want to teach their kids about the enjoyment of sports. my son is young, but he can throw up his pony ears at age 3 and knows how to cheer.

Parents looking for someone else to watch their kids, then they sue if something happens to the precious little ones because mommy and daddy were to busy doing something else when they should have been looking out for their kids.

I get it, I mean Im fine with putting some pads down, hopefully isnt too much of a burden for the school. Im sure if it is though then obviously there is plenty of people who would chip in. I enjoy watching them in the distance sliding down, so I mean im all for it. I dont want a kid to get hurt believe me, but I think there needs to be a line in the sand (in general with everything else in the world) where people need to take responsibility for their actions (or lack thereof) rather than blaming on the hosts. I mean its ridicoulous that if a kid jumps over your fence and drowns in your pool that you could be liable for it. I mean its horrible someone drowns but I fail to see why its the hosts fault. Again this is all about some padding so why not. Yes I agree with putting a nice little club/bar area.

Or if those kids are dumb enough..... put up targets on the hill side of the wall, and charge their parents for the kid to slide down the hill and hit his/her head on the target. Three bulls eyes get you either a miniature stuffed mustang, a free CT scan signed by Dr. John Baker, or cocktail coupons redeemable for the parents at 110.

I think it qualifies as an attractive nuisance. I don't think SMU would get out unscathed if something bad happens. That said, watch your kids!

It did not help any when they did this, thus it no longer exists.
