By the way - trading an SMU education for a Baylor education would constitute damages.

Clearly an attempt to dogpile Baylor who they think is prone to avoid bad pub these days - hoping for a settlement. A bad lawsuit sometimes still results in big institutions settling to avoid the pub - (extortion) - that was their hope, and it looks like it backfired.

I thought I read that attempting to use inducements in violation of NCAA rules was criminalized in Texas. Maybe I read something different. If that is the case it goes out on a Motion to dismiss. If that is not the case, then it is a jury question as to whether the inducement against NCAA rules violates "public policy". That being said, giving up SMU and Dallas and its great looking women to go to Baylor and Waco, well, some could say that Elsey clearly suffered a detriment.

I know one isn't supposed to judge a book by its cover but just looking at the guy shows you that he has other detrimental issues. haha

Actually, I believe Elsey had decided to transfer away from SMU before this meeting. The question was simply where would he go. I don't think the recruiting trip was while he was still at SMU. I don't think he left SMU in reliance on any promises. That decision has already been made. It was just a matter of where he would end up.
