Kind of analogous to the U.S. Constitution, isn't it? Having clearly defined rules never stopped activist judges from reading completely unintended meaning into those words.

McCormack, an alumnus and a lawyer, sued the N.C.A.A. in federal court on behalf of Southern Methodist’s graduates, its students, and several players and cheerleaders, accusing the N.C.A.A. of breaking federal antitrust laws. The class-action suit charged the N.C.A.A. with, among other things, imposing penalties unequally and without due process. "

For the New York Times to completely miss the point of the SMU case in its headline is pretty sorry. Alumni and fans clearly have no standing-the Govenor of a state almost surely does

They did miss the point. I argued for 20 minutes that that case was a non-event. Kept trying to put words in my mouth. NY Times really really wanted to use that case to argue a conclusion they already had about PSU case.
