Article seems to indicate that they were having trouble trying to figure out the consent issue.

Claratin is available without a prescription now., so it's probably not Claratin.

Ok so obviously the drug was something the police felt COULD impair her judgement, but I would think they could have resolved that much sooner. I wonder if it was a drug one of them was prescribed for? Also are they implying the guys gave her the drug? Obviously if she was incoherent and couldn't walk then it wasn't consential but is that really clear that was the case? We probably will never know. The situation is bad for all involved no matter the result.

I think that might be alittle different in that everyone, including victim, were more localized.

It appears that he also has a good reputation locally and as a number of people have already spoken up as to his character, he might get a trial based upon facts.

My only problem with a case like this, is that obviously no one involved was using good judgement. They may have all agreed to get "waisted", even take "pills" and jump into bed with one another--who knows and who remembers? Three lives are at stake an there will be no "winners".

As June said, we should feel awful for everyone involved.

Ok ponyinNC I hear ya...but it just seemed to be the implication was
"well she probably deserved it"...I guess we'll see when more details are released..

The question will be who gave her the drugs and when? If someone else gave her the drugs and she was wasted, but not unconscious, then a jury might find that she was not too impaired to consent or have some sympathy on the guys who couldn't tell the difference. If she took the drugs herself and was not unconscious then a jury might find consent. But if the guys gave her the drugs, they're in a world of trouble.

I really hope this is not true. This would be extremely hurtful to our program as it is finally turning around. We need all the good press we can handle right now.

I'd be interested to know how it can be determined whether a drug was administered "without her knowledge."

I hope the best for all involved here, if the incident took place in Huntsville, that means the case will be in Huntsville, which means that court hearings, plea hearings, grand jury hearings,pre-trial hearings, and trial (if it comes to that) will all be in Huntsville. This could be a lengthy and consuming process for all, I dont think you will be seeing Torlan around campus much. Truly an unfortunate event.

I can guarantee that if a person takes ambien (sp?), they can consent to many things and it is also a sexual stimulant, but the person taking the drug will not recall much if anything the next day. The main question I would ask is who administered the drug. If the girl took a drug such as this on her own even though it was someone elses, they could have well thought she had her full sense about her. If they slipped her the drug then they should get what they deserve. I am not trying to speculate on what happened but can speak from experience around a person who takes ambien.
