10.2

Coach therefore agrees, and specifically promises, not to accept employment, under any circumstances, as men's fb coach at any institution of higher ed that is a member of NCAA....requiring performance of duties prior to the expiration date of this contract (june30)...without first obtaining a written release of this Agreement or a negotiated settlement thereof in writing accepted by Coach and the University.

Yeah, and 4.1, since his contract runs thru June 30. Has to be released.

10.4 liquidated damages of $400,008. Why would that cause a big problem?

Don't know wny there'd be a buyout of this because he's completed the contract. At least that's what Steinberg's saying.

I guess he could just promise to do a real crappy job for them unitl June and then come on over. That would certainly hurt us but it could shut them down.

10.4 if coach breaches under 10.2 then the damages are $400,008. No problem.

It'll cost him $400,008 to get that release. Wonder how they came up with that odd figure.

Didn't Frazier already say something to the effect that UH wouldn't stand in the way of him going elsewhere? It would really be a dumb move at this point anyway, since his agreement is done before next year. That would just [deleted] him off and he'd take an NFL asst. job next year.

Maybe SMU doesn't want to pay the LDs. It's not chump change, you know. (It's easy to throw around someone else's money.)
