[b]I'm going out on a limb here and saying Penn St. will be only the 2nd team ever to receive the Death Penalty. Just sit back and watch!

Why? Has nothing to do with NCAA violations. Just violations against humanity on an unheard of scale. NCAA has no balls or teeth.

DP is not even a consideration. There is pretty much nothing the NCAA can do to Penn State as these misdeeds did not involve student athletes or prospective student athletes. Expect to see Sandusky in jail and hopefully Paterno, the AD, president, and McQueary slapped with accessory charges for not reporting to the police.

Wouldnt any person over 6th grade be deemed a "recruitable athlete"?

Think about the legal entities that have to conclude their investigation before the NCAA can get involved. State, federal, Board of Education, and private inquiry by the university will be doing their own independent investigations into the program and Sandusky's ties to the university. I can see the Feds telling Penn State to shut the program down until they've concluded their investigation.

What about the fact some of these crimes took place in their athletic facilities?

I agree that the DP is not probable, but there are very clear NCAA guidelines of how staff within an athletic program as well as the university administration should be conducting themselves.
Any lawyer could find an opening to argue those points.
