May not have to buy out. Negated any contract by accepting another position.

There is no non-compete clause. He had Orsini's permission to interview.

Usually if there is a Buyout you are recognizing your damages to be limited by that amount

The buyout is no longer in effect at the beginning of 2012 to my understanding. We could a few more weeks and do it then.
