Took my girlfriend and her family to 1st and 10 in Lakewood last week and enjoyed it. I'll be happy to go there again! On another note since we're talking about SMU attire check out the sweet gift my girlfriends mom made me for christmas for my old pro-v1's that I use for workin on my short game... along with a tree ornament...

A) Unless the logo is properly licensed, SMU is not getting anything from the sale of the shirts.
B) Trademarks can be lost if not defended.
C) From the picture, nowhere does the shirt say SMU, so it would not likely be recognized by observes as supportive of SMU.

Well if the SMU running pony can be used by anyone without SMU’s permission. can someone with Photoshop take this below image and put this guy in a red and blue uniform with a running mustang on the hat?

When it comes to producing attire or other objects with an SMU logo, the university does not always have producers/marketers play by the same set of rules. I saw SMU set a double-standard last season by allowing certain producers of a particular product containing one or more SMU logo to mass produce and sell for monetary gain without obtaining licensing permission.

Someday, someone will invent SMU swag that isn't just awful. Neither retro or cutting edge just a boring logo shirt w/colors that seem confused

As someone else noted, there really isn't prosecutorial discretion for trademarks. If you fail to enforce them, or enforce them selectively, there is a risk of losing the trademark.
Fair use is a separate question, but I don't think these qualify, since they aren't a parody or artistic interpretation of the logo. It's just the logo on the shirt for the purpose of selling shirts.
