SMU on Jim Rome Today

Jay Mohr filing in for Jim Rome today and talked about SMU and its death penalty vs. Penn State and what should happen to them death penalty wise. Essentially said Penn State worse than us, and they should cancel football for at least next year. This is same thing Bob Costas and others have now said about Penn State not playing next year.

Not going to happen. If the Lesbian, Gay, Bisexual and Transgender department at PSU had a similar event occur, would PSYU close down the department for a year? Never. And so too never will PSU close down one of the most lucrative departments in the university's revenue stream.
What happen at PSU is vile and despicable. Criminal penalties should and have applied. The DP or blaming the football team for Paterno's lack of judgment is a stretch (my opinion and certainly subject to disagreement). Paterno and those involved should be punished. The football team didn't build the showers, maintain the showers and none of the football players knew any of this was going on. And so too alumni were not involved (to our knowledge) of the behavior Sandusky was performing.
The DP is for gross violation of voluntary rules. The actions at PSU were violations of state and federal laws. Thus, the penalty should be at state and federal levels, not the NCAA.

As others have stated, the DP does not apply to the PSU case, however, the NCAA can and is involved under the "lack of institutional control" concept.
What I predict is, PSU will be sanctioned and sanctioned hard. Harder than the USC sanctions. It will be the hardest sanctions ever levied by the NCAA, except for the DP, which does not apply. PSU will lose scholarships, recruiting visits, coaching positions and post season play. And, they will be put on long term probation.
I feel sorry for the current players and coaches, but the university and athletic department has to pay for its past sins. If they were allowed to skate by on this one, what would keep an institution from violating the "institutional control" doctrine and cleaning house every 4 or 5 years and saying "but the current coaches and players are not involved"?
The hammer has to fall and fall hard, and I predict it will.
The coaches and administrators involved will and are facing criminal and civil charges, and will never be involved in college athletics and administration ever again. Their careers are over and hopefully their bank accounts will be emptied. The university is also facing severe civil charges and judgments.
If the university self imposes a one or two year shut down of the football program, that would help public relations and might help with civil penalties, but don't get your hopes up. There is no reason for PSU to cancel football, and with all the civil charges and judgments that are in the not so distant future, they need all the money they can raise. That is why I don't think they will shut down the program.

I have never agreed with the idea that players who are blameless should have to pay for the sins of their elders. Our cancelled seasons were terrible miscarriages of justice insofar as the effect on the players, their academic careers, and their athletic ambitions. The huge majority of SMU fans and boosters were blameless for what happened and we payed a price as well for activities we weren't involved in. Penn State has done the same thing as so many Division 1 programs: They have allowed the football program to operate outside normal parameters of control. If they decide to play this year, they should turn their tv money and gate receipts in excess of the player's scholarships and associated costs overto educational scholarships for children who need help. Coaches salaries should be paid for out of the general fund. In other words, the program should operate at a loss.

I am not aware of another football program that has tolerated child rape.

I thought it was a player who saw sandusky raping a boy in the shower and told paterno....

It was a coach that saw Sandusky having his way with a little boy. He told Paterno who theen covered it up. And the football department didn't enable, condone or tolerate child molestation. Paterno did.

Punishing the football team just because the football coaches perpetrated this vile act is similar to punishing the LGBT community just because the molestation happened within a similar gender - it's not a fair response, not a fair accounting of what truly went on.

Remarkable how ponyte chose the gay rights department as opposed to the English, Spanish, Math, etc etc etc departments that a university might have.

yeah sure...none of the other coaches or anyone in the athletc dept knew Sandusky was a sicko
except JoPa, the AD, the janitors, and the Assist Coach that saw him hammering the poor child in the shower.....

the football 'program' IS the coaches/staff/players. actions or inactions by them are a departmental issue. player issues are 'team' issues (see TCU:drugs or how about SMU:payments)
the university is an institution. institutional controls involve the WHOLE of the program. including coaches, staff, players, janitors, interns, graduate assistants, etc. or else there is no accountability anywhere.
