I have no animosity for Texas; however, I think they may soon find themselves in an interesting situation.

In 2009 the University of Texas went back to the Texas Legislature to seek relief from the top 10% law as there was a concern that all of the University’s first year class would soon be filled by automatic admits. Not the ideal situation for recruiting athletes. So, the Texas Legislature limited automatic admissions for UT to 75% of resident admissions and limited nonresident admissions to 10% of the student body.

However, the Legislature added a little condition on this new limitation of automatic admits:
A general academic teaching institution may not offer admission under Subsection (a-1) [limitation of automatic admissions] for an academic year if, on the date of the institution's general deadline for applications for admission of first-time undergraduate students for that academic year:(1) a final court order applicable to the institution prohibits the institution from considering an applicant's race or ethnicity as a factor in the institution's decisions relating to first-time undergraduate admissions. . .
President Powers had promised the Texas Legislature that he would use affirmative action to admit minority students who were not admitted automatically.

The U.S Supreme Court has recently agreed to hear the case of Fisher v. University of Texas, which directly challenges the University of Texas’ use of affirmative action in non-automatic admissions.

One argument is that the University already has a less restrictive means for increasing minority enrollment (automatic admissions) and therefore, affirmative action is not warranted.

Anyway, there is a decent chance that the U.S. Supreme Court will prevent the University of Texas from using affirmative action for non-automatic admissions.

If that happens, UT’s entire first year class could be filled automatically.

As you know, the Legislature only meets every two years.

It will be fun to watch Powers go back to the Legislature to beg for some slots for Mack Brown's recruits.

In the meantime, there could be a disruption in UT recruiting.

that would not disallow scholarships for athletics, music or anything else. That would take a separate law suit. Nice try but totally off the chart as a possibility

I didn't say it would disallow scholarships; but it could disallow admission to anyone not able to meet the automatic admission criteria (probably most athletes).
