At least for a great number of the administrators and coaching staff, I don't think that's going to be a problem.

Death penalty -- please?

From what I am seeing, Penn State is not participating in the (potential) lawsuit, thereby not violating their agreement with the NCAA to take their punishment without objection.

I'm torn. I don't know which organization I hate more.

Penn State is just loathsome on all levels.

It was disgusting listening to the (primarily ESPN) announcers feeling sympathy for the university during their women's soccer run to the national finals and their women's volleyball run to the final four and talking about how healing they were. Not to mention the occasional mention of Bill O'Brien as the coach of the year.

People seriously just don't get it.

Doesn't their state government have anything better to do with their time and resources?

I just still have anger issues with the ncaa dealing death to us, and then saying King's X
when others fit the penalty.

The ncaa deciding it can fine a university 60 million dollars without due process for something
really unrelated to athletic rules is just scary to me

The court case will provide due process.

Part of the decision to punish Penn State was their culture towards football above protecting children. So this proves the NCAA was correct in their interpretation as one of the problems at Penn State. Clearly Penn State supporters ignoring this fact and showing no remorse.

I have always thought there was due process issue with the NCAA imposing death penalty sanctions or even draconian penalties for criminal behavor by individuals at state institutions for breaking NCAA Bylaws that are meant not to regulate criminal behavior but instead illegal recruiting and competitive conduct. We have a criminal and civil court system which the NCAA usurped. Instead, the NCAA made a tortured interpretation of its own Bylaws to do the job that is reserved for the Court system. There is zero precedent nor clear and definite NCAA regulations concerning sanctions for criminal conduct. Under what authority are they authorized to imposed draconian monetary sanctions? As for SMU we got everything we deserved because there is absolutely no doubt there could not be a clearer example of lack of institutional control over areas that the NCAA is authorized by its Bylaws to adjudicate

We got what we deserved, but afterwards others didn't

I'm not a lawyer, but I think you said the ncaa grabbed bylaws out of the sky to fine the evil ones

If Joe Pa was protecting a child molestor, what do you think he did about the more normal violtions--grades, eligibility, incentives, off campus violations? The NCAA could still reopen this book and find several more items to punish them for.

They were on television almost every weekend, played a full set of home games, other than limiting their recruiting numbers the penalties seemed insignificant. But then again, it was the result of how the school handled the problems and pulled everyone together instead of tearing everyone apart for 25 years!

The NCAA didn't destroy our football program our lack of leadership did!

Yes...technically we did deserve the Death Penalty (two major violations in 5 years). But 29 schools after us also technically deserved the Death Penalty too. So let's stop this garbage about how bad only SMU was. We paid the tax on the entire out of control 1980's college football experience.

I still have a problem with using terms like "illegal" to describe our infractions when we broke no laws as opposed to Penn State breaking actual laws. But there is a valid comparison between us. In both cases the NCAA broke their bylaws to impose a set of penalties. Further, their bylaws clearly lay out grounds for appealing NCAA penalties:

1. School did not break rules
2. School did something that was not actually against the rules
3. NCAA broke their own rules of procedure in an infractions case

NCAA clearly broke their own rules to penalize Penn State...the Infractions Committee didn't even hear the case or determine the penalty...because there were no infractions.

As always with the NCAA and "due process" it always comes down to "standing." I'm guessing the state gets standing...then the NCAA folds since they have no leg to stand on and will never allow discovery.

Blah Blah Blah enjoy selling your own reality to gulliable SMU fans. The actual facts in the SMU scandal define lack of institional control-there has never been another example so clearly fitting the description by the President, AD and Board of Govenors of a University.
