Boise files suit

ESPN reporting that Boise State has filed suit in Boise asking the court to void the $5.0 million penalty it owes for not joining the Big East. Argument-conference it was to join no longer exists.

wasn't boise joining as football-only? which pretty much looks the same as it was supposedly going to when they joined (minus SDSU)?

It was for football only, but when the origionally agreed to join, Louisville and Rutgers weren't leaving the conference then. Also, the Big East was working to try and get Air Force and/or BYU at the time to try and get them more western partners.

Also, wasn't part of their deal with MWC to come back that MWC would pay the exit fee for them or am I just dreaming that?

Boise State's decision to cancel their membership contributed to the recasting of the conference. They added to the anxiety about the future.

The bottom line is that the case will be decided based upon the wording of the contract.
Given the Big East's past "successes" in court, I expect that BSU will be able to cut their exit fee significantly.

I could have sworn that their membership and exit fees were contingent upon the Big East adding additional western teams, which never happened.
Prediction - they pay $2.5M and everyone moves on.

Just to clarify...TCU never tried to not pay their fee. Big East jumped the gun and went to the media saying we were trying not to pay - that was apparently not the case. Just FYI as I understand the intent of your post....and if TCU had to pay then not sure how Boise gets out of it.

That was SDSU. When Boise bailed, SDSU had a clause that said they didn't have to pay an exit fee if there wasn't another team west of the rockies.

Actually, San Diego State held firm as their western partner in the BE until Boise State bailed out.
