How Mason was named coachModerators: PonyPride, SmooPower Re: How Mason was named coachJust to be sure we are still 0-2014, haven't led, and are holding onto that point deficit record right?

Re: How Mason was named coach
Seems like he might be trying to deflect the blame of the performance on the field away from bad recruiting since he was one of the ones saying that we had more talent than everyone thought. #HammerDown
Re: How Mason was named coach
I have never heard he was anything other than DC. Even if he was associate HC, doesn't mean he has to accept being HC. Being named HC in public without his acceptance, and permission is MAJOR LEAGUE lawsuit material ![]() I'm thinking he has a guaranteed position as at least an LB coach or something for about 3 years on the new staff ![]() May the forth be with us.
Re: How Mason was named coach
So if he did not want to be head coach why was he telling people that he wanted to be permanent head coach and thought the would get considered for it if he could win 6 or 7 games and get to a bowl? Also, it is not a good idea to force a coach on a new staff. Last edited by Rebel10 on Mon Oct 27, 2014 7:38 pm, edited 1 time in total.

Re: How Mason was named coachNo. 1-You weren't paying attention
No. 2- There is 0% chance of a successful lawsuit because he agreed to the contract which defines the terms of his contract. If not expressly stated then he is an employee at will meaning he can get fired without cause at any time or at most under the terms of his contract as associate Head Coach which expires in the spring "With a quarter of a tank of gas, we can get everything we need right here in DFW." -SMU Head Coach Chad Morris

Re: How Mason was named coachYou don't know what his contract said. Mason has the right to resign, and refuse the job before
its announced in public implying he accepted ![]() May the forth be with us.
Re: How Mason was named coach
Well from the looks of it if he does not want to coach the team then he will probably get his wish in a few weeks. Last edited by Rebel10 on Tue Oct 28, 2014 7:46 am, edited 1 time in total.

Re: How Mason was named coachBut he didn't. Two scenarios
1) refused to accept Head Coach position-there is no contract only an offer. acceptance is required element of a binding contract 2) he agreed to the contract. If written it would define terms of his contract. If oral for an indefinite term then he would be an employee at will until it was reduced to a contract or perhaps arguably until his present contract expired this spring. A 3 year oral contract would violate the Statute of Frauds unless they got him to accept based upon an unperformed promise to reduce that oral agreement to writing in the future which they failed to do. They didn't make that promise as we all know because they have publically stated that they are looking for a new coach from Day 1-which Mason has acknowledged-he has no lawsuit. Re: How Mason was named coach
Anounced acceptance to the public before actual acceptance. Libel, slander or all of the above. Sorry, I've had about 4001 compliance, and ethics courses. May the forth be with us.
Re: How Mason was named coachLibel or slander or all the above-yeah you're an expert

Re: How Mason was named coachIrrepairable damage was done to Mason's reputation if it was announced that he accepted, and
he didn't. Oh yeah, I had 2 B-law courses at SMU before the thousands of ethics courses. ![]() It's why most HR departments now days will only confirm that you worked somewhere, and supervisors take their financial well being into extreme danger if they give a negative opinion of a former employee to a recruiter. May the forth be with us.
Re: How Mason was named coachWe teach 1000 ethics courses!?! As a philosophy bachelor, that's news to me!
Re: How Mason was named coachOK now I'm having fun
what were the false statements made by SMU that defamed the reputation or character of Coach Mason? that he was qualified to be appointed head Coach? Its neither false or defamatory-two essential elements to a defamation claim Last edited by Stallion on Mon Oct 27, 2014 8:47 pm, edited 1 time in total.
