Bork is alive, he wrote a scathing editorial about Miers in the Wall Street Journal last week. Major misstep by Bush. If they didnt expect a fight, they badly miscalculated picking her in the first place. And to not finish the fight looks really bad. Maybe I'm wrong, but I dont think it would be any worse to have her confirmation denied than it does to withdraw her.
