I agree that he can do what he wants, but some points he needs to consider:
He is the only one using this criteria.
SMU has been punished by the NCAA with several sanctions and we are dealing with it. Toohey is essentially also deciding to punish us, as if the NCAAA sanctions were not enough.
He needs to think long and hard about those two statements and then decide if his stance is still justifiable.
Probaly won't happen...BUT...maybe it will!!

Someone posted a link to the requirements of AP voting and they actually don't get to do what they want. There are some parameters they have to follow. One of them is vote according to performance of the teams. I think a strong case can be made that he is not voting based on performance of the team. The points above are also important.
