Tune in to see what the report is about...an aggressive Dallas police officer arresting two SMU Mustang football players.

Teaser promo just aired.

Brett Shipp's report on an officer using a pepper gun & taser on DeMyron Martin on Lower Greenville Ave. Fred Turner is also interviewed in the piece.

Bob Jenevein is the attorney for Martin & Turner. Is he an SMU Law School graduate?

The officers have not been disciplined. They have been reassigned from Lower Greenville. Martin & Turner filed official complaints with DPD. An internal affairs investigation was 'inconclusive'.

Fred Turner and DeMyron Martin came off looking really good to me. This was a hit piece on the DPD on Lower Greenville and they were the ammunition.

I Tivo'd it. If WFAA doesn't put it on their website, I will try and find a way to host it.

Yes. I think the DMN actually ran a blurb in April. The DC tried to get DeMyron to talk on record about it but he didn't want to at the time.

The arrest was in February, but according to the paper it's back in the news because Martin recently filed a complaint with the DPD.

Bob Jenevein is a Tech law grad, and a former county court judge who left the bench in a bit of a scandal, although I think it was one he may have been inadvertantly sucked into.

SMU RB: Police use of Taser excessive

A standout running back at SMU has filed a complaint with the Dallas Police Department after he says an officer used a Taser on him unnecessarily.

DeMyron Martin of Allen says he was arrested after he was shot with a Taser on Lower Greenville Avenue on Feb. 17 while trying to point out to officers that they were wrongly arresting a teammate they suspected of fighting.

Three others were arrested with Martin, who was charged with public intoxication and resisting arrest or resisting search or transport.

DeMyron Martin "I come up to the officer, I'm like, I touch his shoulder and saying, like, 'You're arresting the wrong people, you need to arrest these people' and he flips out, he goes in my face cussing me out, I'm backing away like I'm sorry," Martin told WFAA-TV.

First Assistant Dallas Police Chief David Brown said the SMU players were involved in a bar fight and were aggressively resisting police, who feared for their safety.

Fred Turner, a running back from Arlington Lamar, witnessed the incident and said Martin had not committed a crime.

Turner, who captured video of the incident's aftermath on his cellphone camera, was also arrested. He said police first accused him of public intoxication, but he said he had not been drinking.

One police report indicates that Turner's actions "incited the crowd," which "began to attack the police officers."

However, no officers reported being attacked by the crowd.

"In this case ... [police] went so far over the line they had to conjure up a charge that doesn't even make sense," said Dallas attorney Bob Jenevine, who represents the players who filed complaints against the officers.

But Chief Brown said the incident has been thoroughly reviewed. No officers have been disciplined.

"We have some witnesses that say this use of force was not necessary but then we have officers saying that the use of force was necessary in order to gain control," Chief Brown said.

Question. If there was some sort of cash settlement in this issue, can the players receive the money or would it violate some nazi rule of the NCAA?

I wouldn't think so. I seem to recall that Zebbie Lethridge out of Tech filed a lawsuit against Dillard's when they accused him of stealing from a store and he claimed discrimation(he was acquitted of the charge). I know he got a big settlement from that and I think he was still playing at the time.

Mrydel you are a genius. We can now get back to the good old days of attracting the best athletes and do it legally. We have a big rich alum accuse a prospective student athlete of some bogus crime. Then let the kid sue the alum. And of course there is a huge cash settlement with the understanding that the kid goes to SMU and plays his tail off. All legal and all sealed (by consent of both parties) so the details are never revealed to the NCAA. Mrydel, did U think this up or is this or is this the way U of Ark attracts kids to the hellhole in Fayetteville?

Arkpony, we need a ruling from the bench.

Actually, these are ONLY SMU stories the DMN covers properly - when it involves controversy, or some sort of potentially embarrassing episode.

Is this the same cop that WFAA previously reported is personally responsible for about 25% of the entire recorded taser incidents in the entire department? Can't remember the exact details but this is one cop that appeared to be out of control.
