The demolition is on-going. In the DMNs this morning, Vodicka said he was not leaving and would have to be evicted, I guess by force. He has filed suit against the demolition company.

Good deal. Thanks. I was out at Moody today showing some friends from work the new scoreboard (Big Betty). It was back in the middle of the floor and the technicians were firing it up. The dirt is flying in all directions out there. The new parking garage across from Moody, the new Crum Basketball Center, leveling the University Gardens Apartments... and it looks like the first block of homes on SMU Boulevard are ready to bite the dust. Also renovating some dorm on Hillcrest adjacent to Snider/Virginia.

So what happens if he leaves the place, can he be locked out. I figure he files this lawsuit, we file a motion to dismiss, he shows up to argue and we lock him out. He then has to negotiate to get back his stuff.

I just realized something. He says he will fight the eviction. When he loses that, and he will, he will undoubtedly appeal to the County Court at Law. I may be wrong but I think you have a right to a jury in an eviction before the County Court at Law if you choose. Any issues about libraries or fraud are irrelevant at that point, but we know Vodicka will try. That will be high comedy.

You know what is probably going to happen? Vodicka is going to trip over a crack in the sidewalk or get hit in the head by flying debris from the demolition. Then he is going to sue the university and try and halt demolition for evidentiary purposes.

He is now quoted as saying he will not fight the eviction but will sue SMU for wrongful eviction once he wins his case. SMU is apparently going to begin the eviction proceeding next week and have the U.S. Marshall's offce serve the papers.

Does that mean that if he wins that suit he gets to live in the library?
