When SMU applied for a trademark they would have to describe how those letters would be used and in fact provide a sample of exactly how the trademarl would look. To trademark the running Red Mustang outlined in white they would have to present an image of a running red Mustand outlined in white-an that is what is protected.
BTW assumed names can be reserved in each state and registered in each county (ex. XYZ, Inc doing business as "Bubba's Fried Chicken" Once the state grants that corporation or entity that name or the assumed name is registered then that company has certain rights in that assumed name to conduct its business in that name in the respective jurisdiction. The state then will not allow any other company to reserve a deceptively similar name as "Bubba's Fried Chicken" to use that name to conduct its business but that is not under trademark law.
Now I am hungry for some fried chicken. Where is Bubba's?

My hometown in New Mexico has a restaurant that for years called itself "Good Eats Cafe." Locally owned, it was the best place in town. Someone visited Dallas, and said to the general manager of a metroplex eatery, "say...we've got one of these back in New Mexico...." Next thing you know, the place in New Mexico had to change its name.
The mom and pop place? Still there. Still the best place in town. Is the Good Eats brand still anywhere to be found in the Metroplex?
Man, have we hijacked this thread or what??

Thanks for the help. I had not gone through this thread until today. Good stuff. I guess some sites have this commitment and other don't.

Chris Clarke is a really solid recruit, if he ends up a Mustang. If The Family makes a run in Vegas, he's going to get a ton of looks from bigger programs than SMU. The fact that they made the finals at the Peach Jam, gave him increased exposure. That said, Ponies staff was court side for much of the tourney giving good face
“When I first committed to SMU, I thought it would take a couple of years of building. But with these players coming in, we should make a run. We have a lot of heavy hitters. It could get real ugly for a lot of teams we play.â€- Jalen Jones
