No I didn't say that-I think the NCAA has pretty well established that automobile and living arrangements are part of the monitoring process of a university-but a school can be lied to easily about that. I didn't conclude that USC was innocent-only drew the blue-print on how any school can avoid NCAA Death Penalty violations when they occur. The NCAA is not going to shut a program down for good faith failure to catch a violation in its monitoring process or even coaches or alumni paying players because there would not be enough teams to fill the bowl games if they did. Its the intentional conduct by university administration officials and bad faith administration of the monitoring, investigation and sanctioning process that gets the Death Penalty. Its not the Cheating-its the Cheating plus Lack of Institutional Control that gets the Death Penalty. Too many want to equate Cheating=Lack of Institutional Control. They are two entirely different things.

But that wasn't true during the probations, and serious sanctions we got
several times in the 60s, 70s, and 80s including our DP. Before Ron
Meyer, and Collins, our violations were fairly minor with some real nit
picking thrown in at least once or twice. Back then there was no quarter
for turning your self in.

Do I understand? You are saying under NCAA rules, it is OK to cheat, if you have processes in place to detect illegal actions and then report those actions to the NCAA? And if you do these things, your punishment will be minor?
Ponce would have loved this.

Stallion, didn't make these goofy rules up. The NCAA, dominated by the BSC schools, dreamed up these wonderful guidelines.
The beef isn't with Stallion but with the NCAA.

Catch the head of the Board of Regents telling the USC coaches to continue making payments and you might have the beginning of lack of institutional control.

Now that strikes me as an oxymoron. Sounds to me like that is direct and total institutonal control. 
SMU's first president, Robert S. Hyer, selected Harvard Crimson and Yale Blue as SMU's colors to symbolize SMU's high academic standards. We are one of the few Universities to have school colors with real meaning...and we just blow them off.

Stallion, how many schools have been hit with "Lack of Institutional Control" since 1990?

actually there have been numerous-but again none that factually come close to SMU. For example, I think Tech might have gotten hit for Lack of Institutional Control for failure to monitor academic issues. Its not completely uncommon. Yep.

but again-its not the violation that gets you lack of institutional control its the failure of the school to monitor and respond to information which should have alerted the university of continued violations.

I think you are right about Tech. I found an article about Kansas getting hit with it as well.

I don't remember any major penalties coming from this; would you say that the penalties for LITC tend to be very flexible?

I think the Sergent Shultz analogy is the best analogy to lack of institutional control. Knowing something is going on, and intentionally ignoring it. "I know nothink".
