Maybe TCU and Cincinnati should lay claim to 2009 National NCAA Football champions, and use it on offical documents. Then let the NCAA take them to court and see what happens.

A boycott of the nationally televised "national championship" by television viewers would work but that ain't never going to happen

TCU and Boise are members of conferences which signed the BCS Contract that authorized the use of the term BCS National Championship.

They can always claim to be TCU Daily Frog National Champions - as voted by TCU students.

No, I know that's what it appears, but is there some type of formula that the BCS can hang their hat on? I suppose that if there isn't right now, they'll make one up when the questions start mounting.
There are conference tie-ins and a selection order for the at-large bids. This is why you will never see #3 vs #4 because they will already be taken by the time the second round of selections have gone through.

This year's selection order went Orange, Sugar, Fiesta--but the bowls who lose their conference tie-ins to the National Championship game get to pick first. So the picks went Sugar, Fiesta, Orange, Sugar, Fiesta. (With the Orange Bowl keeping their tie-in with the ACC champ first.)

So theoretically, the Fiesta Bowl picked TCU before they were available to the Sugar Bowl.
Interesting and good post as I didn't know that was how it goes and why #3 VS #4 doesn't happen even with BCS VS BCS. Too bad though....
The BCS bowls after the detemination of #1 and #2 have been decided by the final poll have no obligation to take any particular school. I believe if you finish ranked in the top 6 you do qualify for a BCS bowl but are not guaranteed. The bowls themselves have the discretion of choosing conference affiliations winners as the Rose Bowl has done with Big Ten vs Pac 10 or whichever matchup they deem to be the best for their bowl. That has many different factors i.e., selling tickets, a large travelling fanbase to add large amounts of money to the local economy, and television ratings based upon the match-up (which team brings the most sex appeal for tv and tv ratings).

Of course you would never think of collusion (hehe) between the BCS boys on this, but what if the powers that be suggested that the Fiesta Bowl take one for the team and bite-the-bullet by having the TCU/Boise St. match-up. This way they let them split that huge payday for themselves and respective conferences just to shut them up and go away. That's the way I see it!
