ESPN.com news services Texas kick returner D. J. Monroe can rejoin the team before the BCS title game against Alabama after charges for driving while intoxicated were dropped in exchange for a plea agreement, the Austin American-Statesman reported. Monroe pleaded guilty to a charge of obstruction of a passageway Friday and received deferred adjudication, local reports said. Texas coach Mack Brown planned to talk to Monroe and his family next week about his plans for the freshman when Brown returns from a recruiting trip, the American-Statesman reported, citing an athletic department spokesman. "He's extremely happy," Monroe's lawyer, Brian Roark, said, according to the Austin newspaper. "He is hoping to play in the national championship game and continue his career at Texas." Monroe was suspended indefinitely after being arrested on a drunken driving charge in November, hours after a win against Baylor. Before missing three games, Monroe set a Texas record with two kickoff returns for touchdowns this season for the Longhorns. He also had 110 yards on 20 carries at tailback. The second-ranked Longhorns will play the No. 1 Crimson Tide on Jan. 7 in the Citi BCS National Championship Game. Information from The Associated Press was used in this report.

The judge got 4 on the 45, twenty rows up, in the Rose Bowl. NO influence though.
Re: Reports: DWI dropped for UT's MonroeNot a conspiracy IF this was the first offense. For a first offense of DWI/DUI by a minor, deferred adjudication is often the "penalty" but it is considered a conviction.

The differnce is that unless Texas laws have changed, there is no deferred adjudication for DUI. So by dropping the charges of DUI and charging with obstruction, in a couple of years the record will be totally clean. My question would be, is this option available for the average person charged with DUI? All those who believe in psycho kinesis, raise my hand

A minor may be fined, and will be required to complete 20 to up to 40 hours community service related to education about the misuse of alcohol. The minor will also be required to attend an alcohol awareness program sponsored by the Texas Commission on Alcohol and Drug Abuse within 90 days. Furthermore, if the minor is under age 18, the court may require the minor's parent or guardian to attend the program with the minor. If the minor fails to complete the alcohol awareness course within the 90 day period, the court may impose an additional license suspension up to six months. For a first offense the minor may receive deferred adjudication, however, an order of deferred adjudication for DUI is considered a conviction. If the minor receives only one conviction for DUI (while a minor), that conviction may be expunged from his record after his/her 21st birthday. If you are under age 18 the court will require your parent or guardian to be present with you at every court appearance.
Re: Reports: DWI dropped for UT's MonroeWe may be saying the same thing. If it were DUI although they do apparently have deferred adjudication, it stays as a conviction. By changing to the obstruction charge it gets expunged. If he us under 21 which he probably is, it would be expunged in either case. I was not aware of the expunge for a minor. That is good though. Working in those mines is hard work and they deserve a break.

He was a 2008 high school grad so he is probably 19 or 20 now. I think the DUI would be expunged on his 21st birthday whereas the obstruction charge is expunged probably in a matter of months (just guessing on this).

Your answer would be no. And of course you wouldn't have the luxury of the best counsel the state of Texas could provide.
