Texas Tech Officials were not in Court so a TRO Hearing has been set for 8:30 a.m. tommorrow morning

...just enough time to round up a lynch mob. This will likely be a circus. If this happened at SMU I could see MM65 rounding up a sign brigade.

So Stallion in your professional opinion would you agree in hindsite that Texas Tech made a huge strategic mistake in not waiting a week to place him on suspension? Wouldn't they have still been ok PR wise to have at least pretended they were still gathering facts, and then suspend him in a week, 2 week, 3 weeks from now?

One thing to remember Tech only has to justify a temporary suspension-not a termination. Surely, they conducted some preliminary investigation sufficient to meet the standards of their due process procedures. I don't know what those university procedures are so I hesitate to comment. But generally its usually not that high a standard for a suspension.

I wonder if the judge will be sympathetic to Leach if Leach goes with the "this is no place for sissies" excuse. Judge Bill Sowder is a Lt Colonel in the reserves who in April 2009 returned from a 12 month deployment.

Two observations. First, they are hanging a lot on the fact that his contract does not include "suspension" as one of the named disciplinary procedures, although I think the "ranging from" language might save Tech on that issue. Second, the affidavit speaks of the irreperable harm as being the inability of the team to prepare for the bowl game. That smacks of harm to the team, not him, and the team is not a party to the suit. Plus, the naming of an interim coach suggests that preparation of the team goes on. And although the petition pays lip service to harm to his reputation, it is not mentioned in the affidavit which is likely the only evidence the judge will have to consider (often live witnesses are not called at a TRO hearing, although they can be).

Interested to see what the court does with this.
I'd kill for a Nobel Peace Prize.

which brings us back to irreparable harm.

Did Leach interview and hire his assistants?
Does he think they're competent?
Does Ruffin have the title of asst or assoc head coach (don't know that one)
Have coaches whose teams have gotten their [deleted] beat in bowl games gotten other jobs?

Pretty tough case to make that he, Leach, individually, will suffer any kind of irreparable harm if he doesnt coach this one game

Give Leach a little more rope please. After this circus is over, will Leach ever coach again? I sincerely doubt it.

As I understand it, Leach's lawyers are not basing this motion on enforcement of the contract, rather they are claiming equitable relief to prevent irreparable harm.

I don't see any irreperable harm to Leach's reputation if he is not allowed to coach this weekend. Putting him on the sideline will not help his reputation at this point. His story will play out over time. There is nothing happening to him that monetary damages could not fully compensate.
