This time against Leach.

Looks like they sided with James when they talked to the administration (before Leach's lawyer leaked selected quotes from them)

I had heard from an alleged close friend of the Doctor that this would be coming down the pike soon-but I didn't want to jump the gun on an internet rumor. Its only logical. As a lawyer who often drafts Affidavits for summary judgments you could tell that what the first Affidavit left out was more important than what it said. The Leach fanatics fell right into the trap and couldn't see logical inferences and inconsistency in this argument. Of course James suffered no injury by sitting in a confined area. THAT's not the point as I said in reference to the ESPN interview when Leach highjacked the interview on this premise. The point is that it is unjustifiable for a Head Coach to bully and humiliate a player with a potentially serious medical condition in order to send a message to the team. Leach's argument unravels from this basic premise. Leach made a serious mistake from Day 1 in attacking a student athlete rather than explain his own disciplinary techniques

Right. And I always thought the initial statement was odd--unless the doctor was being shady and trying to protect his position as team physician since Leach hadn't been fired yet. Looks like the Leach camp just released the one sentence that didn't make them look bad.

It is my hunch that there will be a full house cleaning over this. Assist. staff, med. staff etc. You can no longer, in this day and age say, well my boss told me to do it. I don't see how Leach would be the only one complicent in this. I know people are getting tired of this, but will probably go on for a long time. Also probably settled out of court. Whole new staff by next season.

hey, Lawyers only include the "good facts" in their arguments-I had little doubt it would collapse during depositions or trial

Read both these Affidavits-the Doctor's Affidavit more relevant to the medical condition but the trainers Affidavit is absolutely devastating to Leach's potential lawsuit and future coaching prospects. He unleashed a verbal tirade at James which discounts any attempt to suggest that Leach was simply concerned with his safety. I continue to believe that this should be a reprimmand situation and that all sides should be fired by allowing this to escalate-but Leach's lawsuit has been seriously damaged

What is interesting is the assumption that there is a contradiction between the 2 statements that Pincock made. In fact, there is not. His first statement he says the following:

"I instructed Adam to stay in the garage and out of the sun, so the light would not worsen his condition," Pincock said in the statement. "While in the garage, Adam was walking around, eating ice, sitting on the ground, and, at one point, sleeping; at no point was there any enforcement to make Adam stand up."

His affidavit says:
"Leach ordered me to place James in a dark, enclosed area where James could not sit or lay down."

As Stallion said before sometimes it's not what you say it's what you don't say. Pincock's original statement doesn't really support Leach as much as the media has made indicated. It just covers his own butt a little bit by saying that he put him in the shed but he didn't enforce the no-standing order.
