In theory, yes. There are an endless number of ways to skirt those sort of development laws (typically a variance and large fee), but if any easements exist (as calallen said) those must be dealt with first.

It won't happen here as there are too many residents to the west that will fight any higher uses. The FAR or Floor Area Ratio will limit what you can do and it will have to be buffered as well. It does look like with the field event areas; that we may be actually bringing back track? The money was raised a few years ago to reinstate track and our great AD Copeland realocated the funds.

Another thing..... doesn't this seems like a big waste of space? I see that the height limit on the Dallas side is lower than on the UP side. I guess that is due to 75? Either way it is odd that they are going to include that must green space when SMU is out of land.
It's due to deed restrictions and zoning on that Bairds parcel. We discussed this in a real estate class.
It also has to do with height restrictions that were agreed upon during negotiations for the new Bush Presidential Center so they could have a relatively decent view of downtown Dallas. That's represented by the line cutting through the conceptual site plan on Page 8 of the first document.
