Statement from Bryan McCann

To my family, friends, coaches, teammates, and all Dallas Cowboy & SMU fans,

My good name and reputation mean everything to me. I have never been arrested before and take pride in conducting myself at all times in a responsible and respectful manner off the football field. I was not intoxicated and did not pose a danger to myself or others. I am very grateful that, due to the Constitution and Americans’ strong and enduring belief in due process, I am presumed innocent of this public intoxication charge because I am innocent. I look forward to vigorously defending myself in a court of law. I thank you for your continued support.

Interesting...if he wasnt intoxicated then why the charge? Look forward to hearing what comes of this and hopefully Bryan comes out clean. Well see.

No. He's looking at a fine at minimum when he gets back from the lockout. Since he's not exactly sitting on millions of bucks in the bank, he will be hurting by the time he starts getting paid again and then has to immediately shell out several grand. Even worse so if he actually gets a game suspension when NFL resumes.

Side note, the Ticket reported this morning that the Cowboys have already acknowledged he will face punishment when the lockout expires. If he is found not guilty between now and then, that will obviously play in his favor.

I have always been told if you are ever going to fight a DUI (I am going to include PI in this conversation) that if it is a first offense, fight it all you want. Rant, rave, deny, and scream. Penalty will be the same for first offeders if found guilty. Chances of winning are slim so it becomes a cost decision.

So I say, if he knows he is innocent, fight it. Even if he loses, the penalty will be the same, and he may just win.

Second offense or more you better plea for mercy.

Generally speaking I have a world of respect for the police, but lately there have been a number of instances where things were not handled well by the officers involved. There was a recent instance where the police responded to some kind of domestic problem and one of the people involved had suffered a stroke recently and as a result her speech was slurred. The officer kindly asked the woman to step out on to the porch and as soon as they got out side arrested the woman for public intoxication. This woman was not intoxicated...merely had speech problems due to her stroke. Obviously not the same situation, but who knows what really happened. Perhaps the officer was having a bad day and McCann pissed him off...they are in a bar, so a PI offense is plausible. So let's have a little faith in McCann when he tells us he is innocent. To the best of my knowledge he has never gotten into trouble before.

Anyone walking out of a bar can be arrested for PI. Unlike a DWI, there is no standard like blood alcohol level. All the cop has to do is say that in his opinion you were a danger to yourself or others. He may have only had one beer. He may have stopped drinking hours before. Doesn't matter. It's your word against his.

Because, if you had read my post, the point was that it does not matter if you plea out, go nolo, or fight the charge in these types of cases, if found guilty the punishment will be the same. If you truly believe you are innocent, you have nothing to lose by fighting the charge. If it is a second charge then you had best be on bended knee.

DMN's this morning says McCann was a bystander to an incident at a club where a friend of his was arrested as I recall for PI. Does not say male or female. McCann apparently asked the police if he could take custody of his arrested friend's possessions. The police say that when his request was denied, McCann became belligerent so he was arrested for PI.
