In my experience that's the way these things go down. Some bystander doesn't have enough sense (because of alcohol or whatever) TO STAY OUT OF THE ARREST! Police officers don't usually arrest someone who kindly asks if he can take possession of someone's things when they are arrested. Only when they become belligerent.
