Its not necessarily lack of institutional control if an agent with no connection to the university or even a rogue booster pays a kid obviously headed to the NFL money. Now if he started driving a Bentley during his Junior year then maybe that should raise questions. That's the problem with due process-you've got to prove your assumptions are correct. I didn't hear many SMU fans taking that position when the allegations were directed toward SMU. You've got to prove an organized scheme by representatives of the university or at least a pattern of conduct that should have reasonably raised concerns by those in control of the university

umm, the university is responsible for the conduct of the students as they are part of the institution.

mmm you ought to study up on the responsibility of a university for lack of institutional control. They are required to report known violations and reasonably monitor compliance with NCAA rules by coaches and representatives of the university. No school is going to be put on probation unless they knew or should have known and failed to take prompt action. The fact of a violation by a player doesn't get it.

Remember, most of the allegations mentioned in this article occured during the recruiting process when kids were at summer camps when they were in HS and before they committed or signed the LOI. Institutions cannot be responsible for what happens at an LSU camp in some LA town with a kid who ultimately signs with Auburn. This is real tough and sticky territory and looks to me right now as an area that really falls between the cracks as to whom is responsible. Does the kid's HS bear any responsibility? Is the kid acting entirely on his own when he fully understands and readily accepts the money? Is the kid responsible for reporting the matter? Should the institution be held fully responsible for a rogue booster? At what point does the institution become responsible? Lots of tough gray area issues here.

it is their responsibility to know whether they are recruiting and eligible athlete...if they fail to find out then they are still culpable...it's the not-knowing-the-speed-limit argument, ignorance is not an excuse.

see what happened to Memphis basketball under Calipari.

it didn't matter if JC knew, rose faked his SAT he was never eligible to play.

What does recruiting an eligible athlete mean???? Some summer camps have as many as 250 kids attending a single camp with some institutions running 4 or 5 more camps. Is the institution responsible for all 250 kids at all camps when the coaching staff will look generally look at all 250 then later focus on 15. Kids attend the camps to be coached on skills and techniques first and then hopefully make them selves known to to the staff. At what point is the instutution "recruiting" an athlete in order to meet your criteria????

What I find interesting about the whole situation is that anyone who knows anything about big time recruiting might find this story surprising. Girls, money, cars, jobs. It was going on before my Pony Excess days at SMU and it has never abated. Witness the vultures who descended on our campus the day the death penatly came down. Can HBO shame the NCAA into honestly and equitably enforcing its rules? Not a chance. The foxes guard the henhouse a la DeLoss Dodds and his ilk.

Here's the PAC 10 website based on a Statement by the NCAA Committee on Infractions on lack of institutional control in a pdf-pretty much as I characterized it. Not every violation by a player/recruit can be pinned on a school nor should the clean, rule abiding alumni, fans and players of a school be penalized for the actions of dumbasses over which they have no control or who may have (financial) interests in conflict with the university. ie NFL agents
