they are a small private school they are in a city as opposed to a cow pasture. they did stuff 90% of d-1 schools have done. they meet all the criteria. show your manhood ncaa. drop the hammer.

we speak about the effect the DP had on SMU but if you step back the effect it had on conf alignment was vastly more significant SMU's penalty knocked Rice, Houston, and TCU down a notch into non-qualifying conf's (before they technically existed, but nowadays that relegation would have amounted to killing an average program's viability). Re: Miami booster has detailed ALL to the NCAA- Wow!I think there is more to that rule than you stated. Yes they can go back if the University has not been forthcoming and has deceived the NCAA. That's a burden of proof that has got to be met which may not be as easy as you think unless they show that Top administrators, President or Boards deceived the NCAA. Also I thought that you still have to have a second violation-are you saying Miami was on probation within the 8 year window you described.

i was generalizing, true. but, did you read robinson's article? the burden of proof is on the coaches and administrators to prove that they DIDN'T know what was going on... 20,000 financial documents, 5,000 phone records, 100+ hrs of personal interviews, 72 players confirmed to have done the things that they were accused of by at least one other credible source and over 30 more that haven't been corroborated yet...all extensively researched over 11 months. robinson did a better job of this than the NCAA could ever wish to, he just placed the largest and most complete report on major infractions, maybe ever, at the feet of the NCAA with a big fat ribbon on top. Re: Miami booster has detailed ALL to the NCAA- Wow!OK according to Wikepedia it is possible to impose the Death Penalty even if the preliminary 5 year sanction is not imposed but if within the 5 year period the propriety of the Death Penalty must be considered. In my opinion the NCAA will not impose a Death Penalty unless more than rouge boosters and even these alleged 6 Coaches were involved. This could be interesting precedent to whether SMU did in fact define the Death Penalty to require that cheating be condoned at upper administrative levels(AD, President, Board). The NCAA has operated for the last 25 years I believe under the assumption that a School can protect itself from greater sanctions by institutionally controlling its program which usually means people like an AD, President, Board members or at least Compliance Staff. Those facts are a little less clear in Miami's case at this early stage

However, in 1985, in response to rampant violations at several schools, the NCAA Council passed the "repeat violator" rule. The rule stipulates that if a second major violation occurs at any institution within five years of being on probation in the same sport or another sport, that institution can be barred from competing in the sport involved in the second violation for either one or two seasons. In cases of particularly egregious misconduct, a school can also be stripped of its right to vote at NCAA conventions for four years. The severity of the penalty led the media to dub it "the death penalty," and the nickname has stuck to this day.[1] The NCAA still has the power to ban schools from competing in a sport without any preliminary sanctions in cases of particularly serious violations. In the wake of allegations raised in an exhaustive investigative piece by Yahoo! Sports, Haith professed his innocence in a statement released by Missouri on Tuesday night. The most damaging accusation of Haith, who left Miami’s head coaching position for Missouri this spring, was that he knew of a $10,000 payment to current senior and then-recruit DeQuan Jones. His statement: “In response to a recent news article, I can confirm that the NCAA has asked to speak with me regarding the time I spent at the University of Miami. I am more than happy to cooperate with the national office on this issue and look forward to a quick resolution. The reports questioning my personal interactions with Mr. Shapiro are not an accurate portrayal of my character and per the above I am unable to comment further.’’ If it’s proven that Haith knew about the payment, then he’s done at Missouri. It's simply not survivable -- and it wasn't exactly a popular hire among Tiger faithful anyway. Re: Miami booster has detailed ALL to the NCAA- Wow!So many ironies in this story, not the least that the recent enforcement of NCAA penalties v. USC were brought through the then AD at the U (per committee, of course).
-yes, small private school in a large metropolitan area, competing with pro sports as well for a limited fan base... -booster driven, and alleged coach(es) knowledge of infractions... -the REAL issue will be the dreaded Lack Of Institutional Control clause in this...it will be difficult to prove, and if, IF Miami chooses to fight these allegations, there could be stiffer penalties, like SMU. The U doesn't seem to have met the criteria for the DP, as Stallion stated above (per wiki), and will get a severe slap, USC+ penalties if these things are proven true. I will be AMAZED if the NCAA removes a revenue source (Miami gear) from the stream by imposing the DP...it is not their way. stable-boy for the four horsemen of the apocalypse
