Big 12 Has A New Problem--Good For Big East
With Missouri will likely leave the Big 12 before the end of the week, the news from the Big East teleconference has big implications for the Big 12--it won't be able to steal any teams from the Big East to replace Mizzou, at least not for a few years.
The Big East said it would not allow any school to leave without staying through the 27-month exit period--including playing 2013 with 14 members before Pitt and Syracuse leave for the ACC. At this point, that would mean that the if the Big 12 did want to replace any schools with a UL, Cincy, and/or WVU, they wouldn't be available until the 2014 football season.
So, that puts them back at 9 for at least two seasons. They can either pick off a BE school or 3 and wait two years playing an 8-game schedule in the meantime, or if they want to replace Missouri immediately, their only options are BYU or a team from MWC or CUSA. From all accounts it sounds like the BYU talks died for some reason. (Perhaps this is where the Tulane talk has surfaced.....)

Missouri has a agreed to stay for 2012 no matter what so they would only be at nine for 2013 but this definitely makes the taking a Big East team less appealing to everyone.

I am starting to like the Big East more and more. So much for them being the poachable AQ conference now. I think they are going to be a good, stable home for us (assuming of course expansion keeps moving as expected).

also worth noting - Lousiville voted to increase the fee to 10M - they were present - everymember voted for it.

So what if a Big East school decides to just breach that Contract-they'd owe:
5 Million Buy Out Clause
+
Additional Damages, if proven
-Mitigation Damages
So say a Big East team loses game with Louisville-they would have to reduce their damages by amount they recovered by playing a different team. If they lost damages as a result of TV Contract they would have to mitigate damages based on new Contract which very likely is going to be more valuable than old Contract since the Big East rejected that lucrative TV Contract last March. In fact, if the Big East Contract isn't clearly written and provide for a reasonable Penalty specifically related to the 27 month provision, the Court might just limit damages to the 5 Million Buy Out Clause. You'd have to look closely at the Big East Agreement but Louisville might just breach the Contract and say Adios. Big East then though might have tortious interference with Contract claim against the Big 12 with similiar damage/mitigation issues.

That 10 Million deal has not gone into effect until the invitations are issued and at least 1 team accepts

Louisville is convinced they are leaving to the Big 12 but listening to Chip Brown on ESPN down here and he says 10 not 12 is the number right now and BYU in first but a Mizzou for Louisville swap would not be bad.

Don't forget that big east could lose NCAA aq status if they drop below 8 teams. That would be a direct result of any team leaving before the 27 month period.
