If it happened in 2012 would that void our contract with CUSA so that we don't have exit penalties?

RGV you forgot several teams. A merger of CUSA and MWC would include:

New Mexico
Wyoming
Colorado State
Air Force
UNLV
Nevada
Fresno State
Hawaii (FB only)
UTEP
Rice
Tulsa
Tulane
Southern Miss
Memphis
UAB
East Carolina
Marshall

Not necessarily. The addition of Hawaii messed things up in terms of having an even number of teams. Unless this merger considers inviting Temple or another school for football only, the league will either have an odd number of teams for football or for basketball. I would just keep it at 16 teams for basketball and 17 for football.
