Orsini Conversation Re Justin
Got a voicemail from Steve Orsini a few minutes ago. Remember there are three "jurisdictions" at work here: the student judicial system, DPD, and the athletic department. As far as the athletic department, Justin's been completely cleared and has served his time. That's done. With the DPD, it is still true that no charges have been pressed. That's good, but no word on statutes of limitations. The only thing left is the judicial system at SMU. Steve said he's "looking to get Justin back as soon as this afternoon." Sounded promising.

DA's bring charges by way of indictment, not victims. Statute of limtiations on felony assault, if I read the statute correctly, is three years.
jtstang: Thanks for the info. Now that someone in the know has confirmed, here are my thoughts: It has nothing to do with statutes of limitations. It has nothing to do with whether or not Beard presses charges. If it did, Justin sits the next three years.
Sounds to me it all revolves around the SMU entity resolving the issues with student conduct, and the mediation is successful.

Orsini and Bennett deserve that credit from this board.
Praise will come when there is something to celebrate.

Frankly, if he is reinstated before tomorrow is over, a resolution of his temporary suspension for being accused of a hate crime will have happened inside of one week. I do not know what you people expect.

I thought it was a Class A misdemeanor?

I thought it was said to have been aggravated assault earlier in the week? Limitations for a misdemeanor is two years, I think.

No, you need to praise them now. The athletic department reacted quickly, decisively and justly with the one game suspension. It's out of their hands -- and has been so for several days now -- and in the hands of the student judicial body.
