This is a good thing. The "Hawthorne Effect" could help us by sheding light on the issue. I'd enjoy watching the BCS cartel defend their actions and self-serving methods.

A Congressional hearing would be very interesting. The confidence of the BCS cartel that its arrangement will stand up in a court of law might wither in front of Congress. Congress is not a court of law but a court of law makers and could make the current BCS cartel illegal.
