actually now that I think about it does the duty of mitigation actually apply if they reached a settlement? We're not really talking about a breach. They owed him the money pursuant to the existing contract, and they reached a resolution. I'd bet that absent a mitigation provision in the settlement, there is no duty of mitigation. Thoughts?
